⚠️ IMPORTANT NOTICE

By proceeding with this rental, you acknowledge that snowmobiling is an inherently dangerous activity that involves risk of serious injury or death. You assume all risks associated with operating snowmobiles in backcountry terrain.

1. Equipment Included

Your rental includes:

  • Two (2) Arctic Cat M6 153 mountain snowmobiles
  • One (1) tilt trailer
  • Arctic Cat covers for both sleds
  • Pre-rental safety briefing and orientation
  • 24/7 emergency support during rental period

2. Rental Rates & Payment

Daily Rates:

  • Weekday (Monday-Thursday): $600/day
  • Weekend (Friday-Sunday): $750/day
  • Weekly (7 days): $3,800
  • Extended (8+ days): $3,800 for first 7 days + daily rate for additional days

Deposits:

  • Non-refundable rental deposit: $250/day
  • Refundable security deposit: $2,000 ($1,000 per snowmobile)

Payment Options:

  • Option 1: Pay deposit + security deposit upfront, remainder due at pickup
  • Option 2: Pay full rental amount + security deposit upfront

3. Rental Period

  • Pickup time: By appointment (typically 4:00 AM - 6:00 AM)
  • Return time: By 10:00 PM on final rental day
  • Late returns incur additional daily rental charges
  • Extensions available if equipment is available (contact before return time)

4. Fuel Policy

⚠️ CRITICAL: ETHANOL-FREE GASOLINE ONLY

You MUST use ethanol-free gasoline only. Using ethanol-containing gasoline will result in a $300 fee plus any engine damage costs.

  • No need to refill gas tank before return
  • If additional fuel is needed, Owner will add it and charge accordingly
  • Renter is responsible for fuel during rental period

5. Security Deposit Refund

Security deposit ($2,000) is refunded under the following conditions:

  • Equipment returned on time
  • Equipment returned in good condition with no damage
  • No ethanol gasoline used
  • Refund processed within 3-5 business days to original payment method

If damage occurs:

  • Owner will inspect and document damage
  • Detailed repair estimate provided
  • Charges deducted from security deposit
  • Remaining balance refunded within 7-10 business days

6. Cancellation Policy

  • Cancellations more than 48 hours before pickup: Full refund minus $100 processing fee
  • Cancellations less than 48 hours before pickup: Half the rental amount (up to the $1,000/sled security deposit) is forfeited
  • No-shows: Full rental amount forfeited
  • Weather-related cancellations: Evaluated case-by-case

7. Renter Responsibilities

Renter agrees to:

  • Be at least 18 years old with valid driver's license
  • Watch required safety video before pickup
  • Attend pre-rental orientation and safety briefing
  • Operate snowmobiles safely and within their skill level
  • Obey all local, state, and federal laws
  • Not operate under influence of alcohol or drugs
  • Not allow unauthorized persons to operate equipment
  • Perform daily safety checks (oil, coolant, track tension)
  • Report any mechanical issues immediately
  • Use ethanol-free gasoline only

8. Prohibited Uses

Renter shall NOT:

  • Operate snowmobiles on paved roads or highways
  • Operate in areas closed to snowmobiles
  • Operate during avalanche warnings without proper equipment and training
  • Perform stunts, jumps, or racing
  • Tow other vehicles or objects
  • Operate in water deeper than track height
  • Make modifications or repairs without Owner approval
  • Use equipment for commercial purposes

9. Damage & Liability

Renter is financially responsible for:

  • All damage to snowmobiles and trailer during rental period
  • Damage caused by negligence, misuse, or prohibited use
  • Lost or stolen equipment (full replacement value)
  • Towing and recovery costs
  • Engine damage from ethanol gasoline ($300 fee + repair costs)
  • Damage from water ingestion or submersion
  • Damage from avalanche burial

Optional Damage Waiver ($59/day):

  • Reduces Renter liability to $750 for covered damage
  • Does NOT cover: rollovers, submersion, engine ingestion, avalanche burial, prohibited use, gross negligence, or intentional damage
  • Damage Waiver is not insurance

10. Towing & Transport

Renter requirements:

  • Vehicle with 2" ball hitch (Class III or higher recommended)
  • 4-pin trailer connector for lights
  • Adequate towing capacity (trailer + sleds = ~2,500 lbs)

⚠️ CRITICAL SAFETY WARNINGS

  1. NEVER load/unload while unhitched. Trailer must be connected to vehicle at all times during loading/unloading.
  2. SET VEHICLE PARKING BRAKE FIRST. Always engage your tow vehicle's parking brake BEFORE tilting the trailer. Failure to do this can cause the vehicle to roll, resulting in serious injury or death.
  3. SET SNOWMOBILE PARKING BRAKE AFTER LOADING. Once sleds are loaded and secured, engage the parking brake on each snowmobile before raising the trailer deck.

11. Assumption of Risk & Waiver

Renter acknowledges and agrees:

  • Snowmobiling is inherently dangerous and involves risk of serious injury or death
  • Backcountry terrain includes avalanche risk, cliffs, trees, rocks, and other hazards
  • Weather and snow conditions can change rapidly
  • Renter assumes all risks associated with snowmobile operation
  • Renter voluntarily participates with full knowledge of risks
  • Owner provides equipment only and does not provide avalanche education, terrain assessment, route planning, or safety instruction

Renter releases and holds harmless Owner from:

  • Any injury, death, or property damage arising from rental or use of equipment
  • Equipment malfunction or failure
  • Avalanche, weather, terrain, or environmental hazards
  • Actions of other riders or third parties

12. Insurance

  • Renter's personal auto insurance may not cover snowmobile rental
  • Renter is responsible for verifying their own insurance coverage
  • Owner's insurance does not cover Renter's injuries or property damage
  • Renter may purchase optional Damage Waiver (not insurance)

13. Governing Law

This agreement is governed by the laws of the State of Nevada. Any disputes shall be resolved in the courts of Washoe County, Nevada.

14. Entire Agreement

This Rental Agreement constitutes the entire agreement between Owner and Renter. No verbal agreements or representations are binding. Any modifications must be in writing and signed by both parties.

BY PROCEEDING WITH PAYMENT, YOU ACKNOWLEDGE:

  • You have read and understand this entire Rental Agreement
  • You agree to all terms and conditions
  • You have watched the required safety video
  • You assume all risks associated with snowmobile operation
  • You release Owner from all liability
